Defense questions crime lab’s findings in Entwistle case

In the first apparent victory for the defense, a state police crime scene investigator admitted today tests were not done for "unseen" blood at the murder scene in the Neil Entwistle double-murder case.
"You made a decision not to search for the unknown," said defense attorney Elliot Weinstein.
The defense co-counsel criticized a forensics scientist for failing to test for "occult blood" -- traces that cannot be detected by the naked eye -- in the sink, toilet, doors or floor of the bathroom off the master bedroom of 6 Cubs Path in Hopkinton where Rachel Entwistle, 27, and Lillian Rose Entwistle, 9 months, were found shot dead in a bed on Jan. 22, 2006.
"You have no idea if there was occult blood in the master bedroom?" Weinstein asked state police chemist John Soares.
Soares, taking the stand today in the sixth day of testimony in this international murder trial, said testing for trace portions of blood were only conducted on a towel in the bathroom. The results of those tests, and others for blood spatter on the wall, have yet to be revealed in court.
Soares, who bristled at the defense attorney’s characterizations of his work, did testify that tests for "occult" blood traces were done on Entwistle’s BMW, which was left in a Logan International Airport parking garage. Entwistle hopped a plane back to his native England on Jan. 21, 2006, the day after his wife and child were killed.
Soares said no blood was spotted anywhere in the BMW -- from the steering wheel to the hatch. Weinstein pressed the chemist over why forensics investigators scoured the BMW X3 and not the bedroom.
"It was a no-brainer ... item one" to test the car, Weinstein said.
"You closed the door" on doing the same tests in the bedroom, Weinstein began to ask as the prosecution shot up to object.
"Sustained," said Judge Diane Kottmyer.
Earlier, Soares testified that Rachel Entwistle was found in the master bed with her left arm "pointing out" and her "index finger pointing out" with the rest of her fingers in a "clenched position." Her right arm, according to previous testimony, was draped over her baby girl. Both had been killed by a .22 caliber bullet. The child shot in the chest, the mother in the head just above her hairline, prosecutors say.
Yesterday, Weinstein also pulled an admission out of another crime lab investigator who said they did not test for any fingerprints on Neil Entwistle’s laptop computers. Weinstein said in his opening others may have had access to the laptops where his client is accused of surfing for porn.
This afternoon, a fraud investigator from eBay took the stand to testify about Neil Entwistle’s accounts on eBay and PayPal.
