LAS VEGAS, Nevada–A Las Vegas judge faces a public disciplinary hearing this week that could result in permanent removal from the bench. Hon. Elizabeth Halverson is accused of violating several canons, or ethical rules, that govern judges during her seven months on the bench. She was elected in November 2006 and took the bench in January of last year. By May, her assistants and bailiff were no longer working for her; her bailiff had also filed a discrimination suit against her.

The allegations against Halverson include improper ex parte communications with jurors, berating attorneys appearing before her, falling asleep while presiding over a trial, requiring her bailiff to put her shoes on and take them off, not compensating her bailiff for overtime, requiring her bailiff to massage her neck and shoulders and heat her lunch, and putting her husband under oath then asking him for assurance that certain chores would be completed before her mother’s visit.

Halverson uses a scooter, in part, because of her weight and requires oxygen for a respiratory condition. She denies the allegations against her.

After a closed hearing on July 16, 2007, a seven-member panel of the Nevada Commission on Judicial Discipline issued an interim suspension order finding that Halverson posed “a substantial threat of serious harm to the public or to the administration of justice.” Halverson has been suspended since then with pay. This week’s hearing follows the subsequent filing of formal charges. Halverson is represented by Michigan attorney Michael Alan Schwartz.

The panel’s decision does not have to be unanimous. If imposed, sanctions range from requesting a public apology to permanent removal from the bench.

Suspended Nev. judge has surgery for fractures

LAS VEGAS—A suspended Nevada state judge underwent surgery for skull fractures after her husband was arrested on suspicion of hitting her with a frying pan, a friend said.
Bobbi Tackett described Elizabeth Halverson's condition as serious at Sunrise Hospital and Medical Center, where she underwent surgery Friday. Tackett met Halverson in 2001 when the two worked for another judge.

"She's in terrible pain," Tackett said after visiting Halverson on Saturday. "She's hurt very, very badly."

Hospital spokeswoman Ashlee Seymour on Sunday said Halverson's name was not in the facility's patient directory. But patients can choose not to be listed.

Edward Halverson, 49, was arrested on charges of attempted murder and battery with a deadly weapon. He was being held pending an initial appearance Tuesday in Las Vegas Justice Court.

Edward Halverson has been arrested at least 10 times in various states on charges ranging from cocaine possession to burglary, the Las Vegas Review-Journal reported Sunday. He's served almost four years in prison.

His wife of 10 years is breathing out of a mask and can barely speak, Tackett said. She has a tube draining blood out of her head and her eyes are swollen shut from bruises, she added.

"She can't see at all," Tackett said. "She's bruised on her arms, her fingers, everywhere."

Elizabeth Halverson, 50, was found in a rear bedroom of her Las Vegas home late Thursday with severe head, chest and upper arm injuries. She told police that her husband had beaten her and tried to kill her.
She was suspended from the bench in July 2007, six months after being sworn in.

The Nevada Commission on Judicial Discipline filed 14 formal charges, including creating a hostile work environment, hiring a technician to try to hack into the courthouse computer system, causing mistrials in two sexual assault cases by improperly meeting with jurors, hiring her own security guards, and falling asleep on the bench.

The commission declared that she posed "a substantial threat to the public or to the administration of justice."

In documents denying the allegations, Elizabeth Halverson has blamed disgruntled employees and vindictive colleagues for the complaints.

The judge recently lost a primary bid for re-election and has been awaiting a decision from the commission on whether to sanction her or permanently bar her from the bench.
