it does not have much to it but denials. one factual question: I see the response asserts the boys were in the tank for rape of natalee among other charges. i think this is not the case. i remember they were arrested for the following: moord (murder), dooddslag (manslaughter) en ontvoeering met dood als gevolg (abbddduction with death as a consequence). they were never charges with rape. so they can't argue that they said nothing that had not already been said. they manipulated the tape to get a gang rape confession where none existed. there never was any official on the recordd, formal talk of gang rape. momma and mammana were the ones who started that. correct me if i am wrong. my adobe reader downloaded it sin problema.

K2 were tanked twice Iquitos. ETA: K2 have the official paperwork at home that spells out why they were locked up.
This is from Vanity fair..
"Once we got a statement from Joran that [Natalee] passed out several times while he was sexually fondling her, we thought we had something," Dompig says. Under Dutch law, this could be viewed as sex without consent; anyone who enabled the crime could be judged an accessory. "We tried Deepak and Satish with that point; someone passed out in the back of your car, you're an accessory," Dompig says. "We were doing this to apply pressure. We felt Satish was the weakest link. We wanted to squeeze Satish. Deepak wants to protect Satish. But when we put that pressure on, it didn't work. Deepak is too strong."
The gambit blew up in Dompig's face. "Then the very same people who wanted us to solve the case—the family and the media—worked against us," he says. "There was all this criticism that we should never have released the [Kalpoes] in the first place. Unfortunately, the judge, you know, he heard this, and he didn't agree with us. So we lost the Kalpoes.

I think when they detained Freddy for the alleged porn, they rearrested the Kalpoes under the suspicion of rape & murder charge "with others".
Sounded like a investigational ploy at the time, even more so now.

NANCY GRACE, HOST: Tonight, breaking news in Aruba, two men re- arrested in the disappearance of Natalee Holloway, the Kalpoe brothers, Deepak and Satish Kalpoe, back in jail tonight on suspicion of rape and murder. They are behind bars right along with the prime suspect, Aruban judge`s son Joran Van Der Sloot.
Good evening, everybody. I`m Nancy Grace, and I want to thank you for being with us tonight. Tonight: Emory University sophomore Shannon Melendi vanished 11 years ago after a local softball game. Tonight, softball umpire Colvyn "Butch" Hinton III on trial for murder. Jailhouse snitches sing to the jury that Hinton confessed the demon inside made him kill the girl.
But first tonight, breaking news out of Aruba, Deepak and Satish Kalpoe in jail tonight. Prosecutors openly state the men are suspected of the rape and murder of 18-year-old Natalee Holloway. This was to be Natalee`s first week of college classes, pre-med, University of Alabama.
Tonight, Natalee`s uncle, Paul Reynolds, in Aruba, Helen Lejuez, attorney for the Twitty family, Jossy Mansur, managing director and editor of "Diario" newspaper. In Atlanta, veteran trial lawyer Renee Rockwell. West Tampa, Florida, defense attorney Joe Espicopo. Atlanta, prosecutor Eleanor Dixon. And in New York, psychoanalyst Dr. Bethany Marshall. Also with us, "A Current Affair" correspondent Harris Faulkner.
Straight to Harris. Bring us up to date, friend.
HARRIS FAULKNER, "A CURRENT AFFAIR": First of all, Nancy, I want to say that picking up the Kalpoe brothers is not necessarily ground-breaking information, but we knew it was going to happen sooner or later. The timing of it is kind of interesting, though, because we`re about a week out before they would have to let Joran Van Der Sloot, the key prime suspect in this case, go from prison because they haven`t charged him with anything yet.
I talked with a police source today, Nancy, who told me a couple of really surprising things. You`ve been wondering what new evidence might they have had in this case. Well, he shared with me that they`ve been wiretapping these boys over the past few weeks. They`ve been watching closely the Internet cafe...
GRACE: Whoa, whoa, whoa, whoa! Wait a minute! My prayers -- my prayers...
FAULKNER: It`s new and shocking...
(CROSSTALK)
GRACE: My prayers have been answered! They ran a wiretap in Aruba. OK, go ahead, Harris.
FAULKNER: All right. So also, this police source telling me -- and I know you`re excited about that, Nancy, because you`ve been waiting for kind of that smoking gun, and maybe this gets us closer. We don`t know that. But the other thing is, they were watching very closely the Internet cafe where we know Deepak was still keeping a job. You know, he opened that shop yesterday. That shop, that Internet cafe, Zyber Zone (ph), was supposed to open today. It didn`t open because Deepak couldn`t go to work because they arrested him this morning. So then the shop opens later, at about noon. We called an employee there to see if, in fact, they had opened late because Deepak was supposed to open. The guy said, Well, I can`t discuss the store schedule with you, but you do the math.
I mean, really, they have been watching these guys. It was just a matter of time.
You know, here`s another thing, too, Nancy. Some people are wondering whether or not that gardener who first they wanted to talk with about possibly seeing people who fit the description of Joran Van Der Sloot and the Kalpoe brothers in a car near the beach, possibly with Natalee Holloway, the night in question here. Then that guy fled to Colombia. Maybe his testimony, getting that on record, might have helped in terms of pursuing the Kalpoe brothers. But at the end of the day, finally, they`ve rearrested these guys in pursuit of more information.
This police source also filled me in a little bit on what their lives are going to be like, and I thought this was interesting. They`re going to let them sit for a little bit, until about 11:00 o`clock tonight, and then they`re going to go in and interrogate.
And I`m curious to know what Beth is going to have to say about that from a psychological point because these kids, from what I`ve been told, are going to get a chance to get acclimated behind bars, get to remember what that feels like, that lack of freedom, and then hit hard with interrogation.

During their incarceration, Van der Sloot told police under oath, on June 13, 2005, that "he thought the suspect Depak Kalpoe had raped the girl and thereupon murdered her." This statement made in the pressence of four police officers, was widely reported to the press.
Oooh, clever ambigue sentence construction here, .. Yes, indeed, the police are under oath, but Joran certainly wasn't. Suspects do not declare under oath during an investigation. That is a complete and utter Mansur fabrication.
If you are looking for the wide reporting on that.. it is refered to on page 5 lines 23-26 which refers to, I asume, http://edition.cnn.com/TRANSCRIPTS/0507/26/ng.01.html
MANSUR: Of course, we caught him in a lie, because, not only him, but the Kalpoe brothers also, because they claim they dropped him off there at 2:00 and then went home.
But they were with him, because in a further statement to the police on the 13th of June, Joran said that Deepak Kalpoe walked back to the beach where he had left Natalee asleep and then he didn`t hear anything more. Then, at the end, when the police asked him what he thought happened between Deepak and Natalee, he said, "I think he raped her and then murdered her."
This is from the police records.
GRACE: Joran Van Der Sloot said a Kalpoe brother raped her and murdered her?
MANSUR: Yes, he said that of Deepak. He mentioned Deepak in that statement.

They know they have a tough case to prove at this point, a murder, first degree or whatever. Then they went back. They went to square one. They reviewed everything that was on the table, and then they decided that with the evidence they already have, that it`s based on the admissions that all three of them made to the police during those days of interrogation, that they have a sufficiently strong case to re-arrest them and take them to court on charges of sexual assault.

Grace, Lejeuz and Mansur not exactly the powers that control this case. They are just the wannabees!
Remember it is Beth who wanted the charges of (gang)rape to be made. So far no evidence that support that. Not even the statements made by J2K.

I'm not sure I understand what the motion is about (or who is filing).
Do the Kalpoes want to substitute Skeeters with his Estate and/or Insurers? Is that what it means or do they want him dismissed? Or does Mrs. Skeeters want him dismissed?
I won't ask about rule 45. Sounds complicated.

Defendants want to know whether Skeeters' estate will be substituted as a party ... that's the only way to keep him in the suit. K2 don't want to designate the estate as a party yet, and they dont want to dismiss him either. They are delaying basically. The motion is filed by attorneys representing Skeeters' interest, in essence his estaste.

You're welcome. There's certainly some strategy or posturing going on .. K2 lawyers say they won't submit Deepak for depositions until all parties are named. Then they intentionally delay naming Skeeters' estate as a party. There's really no reason to delay .. they can always dismiss him later if they want to. They say they are evaluating whether to name him and collect from his insurance company, but again there's no reason not to name him other than delaying/avoiding depositions.
