Utah's top lawyer, Mark Shurtleff, says the key here is handling each custody case one by one. Shurtleff warns that if Texas simply throws the book at all the FLDS followers and their children, then the mistakes of the past may come back to haunt the Lone Star State.

The A.G. says there is a right way and a wrong way to handle Polygamist custody cases. The right way, he claims, is to carefully judge each child's situation, just like his office did with the Kingstons.

Shurtleff said, "A lot of what happens in Texas today, this week and in the coming months continues to impact what we do here."

Specifically, Shurtleff worries that Texas custody authorities may draw a line in the sand and keep all the kids away from all their parents all the time. Then, he fears, Utah polygamists who want help may become too afraid to ask for it.

"If people who are being abused fear us more than they fear the abuser they'll never come forward and seek help," he said.

In other words, Utah's Attorney General is worried that what happened 55 years ago might happen again. July 26th, 1953. What is now known as the infamous Short Creek Raid.

That's when some 400 polygamists were taken into custody by Arizona authorities. Of the 236 children taken into custody, 158 of them were not allowed to return to their parents for two years. Some never did.

Shurtleff: "For the last seven years we've been hearing it. 'Remember Short Creek. It's going to happen again. Don't trust the government. They're going to come after you.'"

We asked Shurtleff if he would like to be down in Texas watching the custody hearings. He said absolutely.

He also tells us he's been invited to tour the FLDS compound in Texas and admits he would like to see it.

Exactly and they are hoping and praying they will get by with it just as they did then. I certainly hope not and that the put an end to this BS...

I dont see how this can really be another Short Creek. In that case, the children were returned to the parents. I dont see that happening here.

If this has been handled properly in 1953, then it would not still be happening today at an even worse extreme...

I guess they could have just gone in like they did on the Branch Davidians...we certainly dont have any problems from that group these days.

I think the branch davidian thing worked out pretty well, actually. Solved all kinds of problems and didnt cost a whole lot.

All religions have extreemist. I dont think that means all religion is a bad thing, it just means there are loons in every denomination. But then, those who choose to follow the loons are loons themselves.

I certainly did not say that all religion is a bad thing!!! I do think that any religion that abuses children in any way, shape or form is wrong...

I would agree. Sexual abuse is every bit as bad as those churches who teach "spare the rod" type stuff. Abuse is wrong on all levels.

Very few FLDS members showed up for the meeting that Shurtleff and Arizona's AG Goddard held a few weeks ago.

Warren Jeffs is the leader of the FLDS, he is their "prophet." They all follow him and believe God gives him directives, which he then instructs them in.
