Convention on the Prevention and Punishment of the Crime of Genocide
Adopted by Resolution 260 (III) A of the United Nations General Assembly on 9 December 1948.


Article 1
The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish.

Article 2
In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.
Article 3
The following acts shall be punishable:

(a) Genocide;
(b) Conspiracy to commit genocide;
(c) Direct and public incitement to commit genocide;
(d) Attempt to commit genocide;
(e) Complicity in genocide.
Article 4
Persons committing genocide or any of the other acts enumerated in Article 3 shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.

An Open Letter to The Honorable Governor Rick Perry and

Dear Governor and Madam Judge:

I am eighty years old. I’ve lived in Texas for almost a year and have been a member of the FLDS Church for fifty-six years. My purpose in writing this letter is to counter the false propaganda that has spewed forth from the Texas authorities.

On April 3, 2008, the state of Texas entered our peaceful community with an army of armed Gestapo-type characters and a horde of CPS workers for the purpose of kidnapping our children and removing them by force from their happy homes because of the propaganda that they were neglected, abused, and otherwise mistreated. These people, according to their own admission, have been schooled for a year or more by lying apostates from our society. This is akin to taking the testimony of an ex-wife who has left her husband and had a bitter divorce to find out what his character is like without using any other source of information. Your people obviously are chuck full and running over with prejudice and false information.

You came expecting to find a neglected and abused group of children. You were surprised to find every child was clean, happy, well-dressed, well-fed, well-housed, well-loved, well-schooled, and well-behaved. This did not deter you one moment; for your people have been schooled and conditioned that this was a den of iniquity, and they came accusing this people of being liars and child abusers. They began asking questions and received truthful answers and then would immediately accuse the person of being a liar. Your people even declared legitimate documents such as birth certificates and driver’s licenses to be fakes. They had no grounds for this behavior other than the lies and propaganda they are stuffed with.

They then proceeded the following week to search our homes and offices and confiscate all our records, computers, and anything they thought could supply evidence. They went through every home at least twice. They claimed they were looking for Sarah Jessop Barlow, who they claimed had called from this land saying she was being held here. There is no such character, and “if” you did receive such a call, it came from an apostate trying to make trouble. You surely have recorded such a call, and with the technology available, voice sound recognition, you could easily identify such a person, but I don’t think you want to identify her because that would take away your excuse that you used to make war on an unoffending people and leave you with egg on your face.

It is a common claim among apostates that they were held against their will and had to escape. I can unequivocally state that this is a falsehood. Anyone who does not have the character to endure the Gospel of Jesus Christ, which is our purpose, is and always has been free to use their agency to come and go as they please. And if they make known their desire to leave, we would supply them with transportation and money to help them. It is against our creed and belief to force any person against his or her will. Such characters who do leave us feel that they have escaped because they did not have the character to live up to the high standards of the Gospel of Jesus Christ, and so their escape is the feeling they have from having laid off the burden of the principles of the Gospel of Jesus Christ.

Now, Madam Judge, you have repeatedly declared in your court that this has nothing to do with religion. I state to you and unequivocally declare that it is nothing but a religious issue. You all seem greatly concerned that we allow one man to have such great power over us. I declare to you that the one man we reverence, worship, and obey is none other than the Lord Jesus Christ Himself. He does not walk among us at the present time (but the time is soon coming that He will), but He does have one to represent Him on the earth until He comes to rule and reign upon the earth. That man with the authority to represent Jesus Christ is Warren S. Jeffs, and this is the reason he is hated, vilified, and lied about because the world in general has turned their hearts to Satan and rejected the Gospel of Jesus Christ. This, dear people, is the contest you have embarked upon, and you have allowed yourselves to be ensnared into doing the devil’s work by enlisting for your consultants and advisors the devil’s angel’s, who are very adept under Satan’s rule to couch their lies in just enough of the truth to sound plausible.

If you scoff at this information, consider your own actions. Every church in America has rights except the FLDS Church. You would have been restrained from forcibly entering a church, temple, synagogue, or a sacred edifice of any other religious sect; but you came in here, and with your storm troopers desecrated our holy edifices without a thought of our civil rights or religious rites, guaranteed by the Constitution of the United States.

When you searched our homes and buildings, you did not find a weapon of any kind, except you may have found a bow and arrow, which we use to harvest the wild animals that we purchased along with this property. You knew that we were unarmed and peaceable, and yet after you knew this, you transported in here that military tank-type personnel carrier to storm our temple with because we offered our peaceable resistance by surrounding the premises without arms of any kind. The only defense we offered was with songs and prayer. Still you came charging up at a high speed and steered toward a man standing at the gate as if you intended to run him over, but he stood fast, so you slammed on the brakes. Your troopers bailed out as if they were ready for combat, and two of your huskies took him by the arms and violently carried him across the road and dumped him. Now I ask you, what was that all about? If you thought to intimidate us, it didn’t work. We stand firm in defense of our God-given Constitutional rights.

Now as to the 464 children you have kidnapped by armed force, your propaganda is that you are doing this for the benefit of the children. In fact, your conduct has shown that you (the state) are doing them exactly what you accuse us of doing. Your actions belie the claim that you are interested in their welfare. You have abused these dear children by taking them out of an environment of being loved and well cared for. They are now treated like a herd of pigs, deprived of comforts and proper care. You are not seeking for their welfare, but you have subjected them to the most intense and cruel questioning---not to find out the truth but in a effort to twist what you hear to suit the demands of your agenda, which is to destroy this religion and the faith of these innocent children. You are determined to destroy their integrity and make them like yourselves. You accuse everyone of lying to you, while you (the CPS workers) have done nothing but lie to the mothers and children in every instance. Some of the workers admitted that they were told that to tell us lies was acceptable in order to get us to conform to their wishes. Your unrelenting and hare-hearted method of questioning those children is nothing but mental abuse. These children are used to love and confidence and have been taught to be truthful. Your hellish treatment has caused some of these sweet, innocent children to be traumatized, and some have even had to be hospitalized. The children themselves, without any prompting, have declared that your CPS stands for Child Persecuting Service.

In one instance a fourteen-year-old girl refused to take a pregnancy test, so you naturally assumed she was pregnant, but you insisted that she was thirteen years old and pregnant. So to satisfy your demands, she allowed the pregnancy test. You gave her the test 5 (five) times, and it was negative every time, but you will not believe your won evidence and still insist she is pregnant.

One has to wonder if your people do not recognize the truth because they’ve never been introduced to it. Perhaps you could give them a little schooling and inform them that truth is a principle that stands on its own feet regardless of your opinion about it, and whether you believe it or not, it still stands on its own feet. Truth is what IS. This concept appears to be outside the realm of your CPS personnel’s understanding.

I throw out a challenge to you, Governor. If the state really has the interest of the children at heart, let us consult their interest. They have been in the state’s “tender care” and “benevolent treatment” for a month now, which is a fair test for them to see what they can expect from the state. My challenge to you, Governor, is that you appoint a person of integrity and who is not a representative of the state or of the FLDS religion and commission that person to interview the children individually, not in the presence of the state or their parents, and present to them their choice of being in the care of the state or returning to their homes. Now extend to the underage wives, whom you feel so solicitous of, the same choice with a covenant on your part that you will keep all who prefer your tender care and let the rest have the desire of their hearts to go back to their homes. Then I will believe the state’s assertion that you are interested in their welfare and are not using them for pawns in your attempt to destroy the Fundamentalist Church of Jesus Christ of Latter-day Saints in your state.

About here, you are putting me down as an old fool with a persecution complex. Even though this letter is getting long, allow me to give you a brief history of our Church. First, let me say that God through revelation has declared that through His power this nation was made free and that He inspired the Constitution of the United States for the specific purpose of restoring the Gospel of Jesus Christ, with Priesthood from on High, for the last time in the last days. The instrument He chose to accomplish this was Joseph Smith, Jr. He received the Aaronic (Levitical) Priesthood under the hand of a resurrected John the Baptist. He then received the Melchizedek Priesthood under the hands of the resurrected Peter, James, and John. He then received the Keys of the Gathering from a resurrected Moses and the Sealing Powers from, the resurrected Elijah. He was told by the Lord that his name would be known for good or evil in all the world. That certainly has been fulfilled. He had power to administer the saving principles of the Gospel. Were these glad tidings received by the people generally? No. A few of the honest hearted believed and hearkened and were greatly blessed while the large majority of the people rejected these glad tidings out of hand without investigation, so he and his people were driven, hated, and lied about, and lied about. He was called an imposter and a deceiver and was driven out of the states of New York and Pennsylvania. He and his people sought refuge in Kirtland, Ohio, where they prospered and built a temple and a city. At this, Satan began to rage in the hearts of the selfish and proud, which caused great apostasy from the Church and put the leaders’ lives in jeopardy. Therefore, the leaders and the faithful had to flee to the western frontier in the state of Missouri. Books have been written about their persecution and sufferings and the exterminating order of Governor Boggs. I can flatly state that the Saints were the only law-abiding citizens in the state. Suffice it to say that they were driven from their homes, beaten (one man was tied to a tree and beaten until his bowels spilled out on the ground), murdered, raped, robbed of their property, and driven from the state at the point of the bayonet in the winter, many walking without shoes or adequate clothing. They migrated to the north and found refuge in the state of Illinois.

By their industry and hard work and the blessings of God, they drained a swampland and built a beautiful city on the bank of the Mississippi River called Nauvoo. In five years’ time Nauvoo numbered 20,000 souls, which at the time was the largest city in the state---larger than Chicago. They again built a large and beautiful temple for the worship of their God. At this, Satan began to rage in the hearts of the wicked and unbelieving, and they again began to persecute and lie about the saints, accusing them of all manner of wickedness of which they were innocent. As they always do, the apostates (who are few but always with us), became tools of the devil and, joining with the mob, murdered the Prophet Joseph Smith and his brother Hyrum while they were in the Carthage, Illinois, prison. The Prophet went there on an illegal writ by a judge who was a member of the mob that murdered them. The mob stated that the law could not reach him (as he was a law-abiding citizen), but powder and ball could. And so it was. He had been hauled into courts fifty-two times by false accusers and was acquitted in every instance. The leadership then fell on Brigham Young, but the persecution did not cease, and so it was determined to leave the United States and migrate to what was then Upper California and part of Mexico, now known as Utah. Now could they enjoy peace? Only for a short time. Through their industry and hard work they made the barren desert blossom as the rose, but again Satan put it into the hearts of the federal officials sent to the territory to lie to the government that the Saints had destroyed the records and were rebellious against the United States Government---all lies as usual, as has been proven by history. As a result of these lies, there was an army sent out to Utah to quell a rebellion that did not exist. But that is a story of its own. Suffice it to say that the affair was amicably settled. Suffice it to say that through lying officials and unjust federal judges, the Church was again under siege by the federal government, mainly on account of polygamy.

Let me here state why we adhere to this principle of marriage. Let me first state that monogamy does not come from the Gospel of Christ but had its origins in the Roman empire, which ruled over most of the earth, and they it was who established the law of monogamy. Men were allowed but one wife, but they were allowed to have as many mistresses as they pleased. The marriage law of polygamy was as much a part of the Gospel of Christ as was baptism. This is evident in the life of the father of the faithful, Abraham, whose wife Sarah was commanded of god to give Hagar to her husband to wife. This principle was carried down through t he faithful, exemplified by the wives of Isaac and Jacob as also Moses, David, and Solomon and all of the Prophets as well as the Children of Israel. This was not by way of toleration, but it was the law of God.
However, this is not where we take our authority from. In 1843 the Lord gave the Prophet Joseph Smith the revelation in Section 132 in our Doctrine and Covenants, commanding the faithful Latter-day Saints to obey this law. It therefore is one of the laws and tenets of our religion, and when it is adhered to, it brings great blessings to the faithful who live it faithfully. Let it be understood that God does not apply this law to the general public, but He reveals through the living Prophet who should enter this law. Now this is part of our religion. Now inasmuch as God inspired the Constitution for the very purpose of guaranteeing the right of every religion to have free exercise, who gives anyone else a right to dictate to me what my religion should be?

To get back to the subject of government versus the Latter-day Saint religion, or Mormonism as you are pleased to term it. Because of the prejudice produced by ungodly officials and editors, in 1862 the Edmunds-Tucker Act was passed in Congress, specifically to suppress the Latter-day Saint belief in Celestial or plural marriage. And now, to the God-inspired Constitution. The first amendment states: “Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof.” This language is so simple a five-year old can understand it. The Edmunds Law violated the Constitution in two ways. The Church of Jesus Christ of Latter-day Saints (nicknamed the Mormons) was established in the state of New York in 1830, and so Congress did make a law against an establishment of religion. The second offense was to limit the free exercise thereof, so then a case was promptly taken to the Supreme Court for them to declare this law unconstitutional, but the prejudice was so strong that this clear and blatant assault on the Constitution was upheld by the Court. Now the ungodly will say that that is the end of it, but it is not. Wrong decisions can and must be reversed. We stand on our Constitutional right. President Brigham Young and his successor John Taylor held out for the rights of the Priesthood and maintained that when the law of man is made against the law of God, the law of God supersedes the law of man. The word of God by revelation given in 1832 in the Doctrine and Covenants Section 98, Verses 4- 6 states: “And now verily I say unto you, concerning the laws of the land, it is my will that my people should observe to do all things whatsoever I command them. And that law of the land which is Constitutional, supporting that principle of freedom in maintaining rights and privileges, belongs to all mankind, and is justifiable before me. Therefore, I the Lord justify you, and your brethren of my Church, in befriending that law which is the Constitutional law of the land.” Now I maintain that the word “Congress” in its broad sense means the government; therefore, the law passed by the state of Utah that was used to entrap our Prophet on a rape charge that was NOT a rape was sponsored for that express purpose as stated by the legislator who sponsored it. That law is as unconstitutional as Hell itself. And now the state of Texas has concocted laws against our form of religion, and they are unconstitutional.

Now let’s go back in history to the eighteen hundreds in Utah. Under the pressure brought to bear against the LDS Church because of this unconstitutional law by the U.S. Government, using its power to seize the temples and all Church property, the authorities of the Church capitulated and agreed to drop the principle of Celestial or plural marriage from the Church. In 1890 they issued a political document called the “Manifesto.” Their main reason for this was to obtain statehood. This Manifesto put an end to all further revelation from the Lord. In their statement they said that they were giving up a principle that they had believed in all their lives in order to gain a peaceful relationship with the world. And even after this, it took six years for them to obtain statehood. And now they are friends with the world, but they have yielded up the power of the Priesthood, which has the power to save. The Lord arranged four years prior to the issuing of the Manifesto for the Priesthood authority to continue in administering the fullness of the Gospel, and so now the Mormon Church, which for sixty years was persecuted for the fullness of the Gospel, has become part of the world and turned persecutor itself.

Now let us do a little comparing between your (the world in general) lifestyle and ours. Your divorce rate is over 50 percent of all marriages. Ours is less than 1 percent. Your system generates infidelity, adultery, venereal disease, whoredom, homosexuality, drunkenness, lawlessness, drug abuse, thieving, cheating, and murder; and as Isaiah prophesied, your women rule over you and your children are your oppressors. Satan sponsored the movement called women’s liberation to thwart the principle of God that man should be the head of the house.

Our lifestyle has no infidelity, no adultery, no venereal disease, no whoredom, no homosexuality, no drunkenness, no lawlessness, no drug abuse, no thieving, no cheating, and no murder. We do not have policemen because we have no law breakers. We leave the keys in our cars, and we can leave our tools where we quit working, and they will always be where they were left even if it is a week or more later. We can only do this because we have a lock on our gate to keep outside influences outside. If the public were allowed to freely enter our community, we would have to be like the rest of you and lock up our outfits and lock up our tools, etc. By the way, the false accusation that our driveway is locked to keep people in is nonsense. The purpose is solely to keep you dear people out of our midst so that we do not have to tolerate you misconduct.

Bear with me just a little longer. In 1953 the state of Arizona undertook to do basically what you are doing now. Governor Howard Pyle made a national radio address in which he said the children of Short Creek were neglected and sexually abuse, etc., etc. He declared that the state was going to adopt them out and put the mothers in detention homes and the men in jail. Sheriffs, Highway Patrol, etc., entered the community, all highly armed and filled with propaganda that they were going to put down a rebellion. What they were met with was the people assembled (they knew the authorities were coming), singing hymns and offering up their prayers. There was no rebellion. There was no venereal disease. The girls were all sexually pure. Governor Pyle declared that the state would give these children happiness of their own choosing. When he found out that they all chose to go home, that promise was quickly withdrawn. Without going into a lot of details, I will just state that through the mercy of our Heavenly Father every family was completely reunited and returned home. We are God’s people.

History repeats itself. Let’s consider the state of Utah versus Warren S. Jeffs. The Attorney General, Mark Shurtleff, accused him of robbing Church members of their means by the UEP and of being a terrorist, etc., etc., so what does the state of Utah do? They take control of our Church property, which is unconstitutional, by court edict, and immediately begin to steal our means and our Church property that is in the UEP, trying to force us to submit to them. Mark Shurtleff closed the bank in Hildale on the grounds that they were financing terrorists. He got the FBI involved by claiming that Warren Jeffs was a terrorist and getting him put on the 10 Most Wanted list. Shurtleff warned the FBI that Jeffs was armed and dangerous and traveled with a gang of armed bodyguards. And what was the truth? He was picked up in a routine traffic stop, and the only weapons were several cell phones and the salad he was eating with a plastic fork. Now that he is in custody, what happened to the claims of terrorist, etc., etc.? They have no evidence because there is no evidence. I have to ask, “Who is the liar?”

Well, I have run on long enough, though I could say three times as much on the subject. I will just note that the state of Texas has now added their name to the list of states who will not tolerate the Gospel of Jesus Christ and the living Priesthood operating in their state. The list is New York, Pennsylvania, Ohio, Missouri, Illinois, Arizona, Utah, and now Texas. I fear, dear people, that you are stirring up a controversy with God, and I will state that He has all power, just so you know who you are dealing with. I want to make it clear that I am not an official of the FLDS Church. Let it be known I am speaking for myself. Wherein I have used the term “we,” I am merely stating what I understand to be a sentiment of this people. I (we) state I (we) do not make judgments against you and forgive you for your offenses toward us and leave the matter in the hands of God. Good luck.

Dear Mr. President:
We appeal to you, as President of the United States of America and Leader of the Free World, to intercede in behalf of an American community which has been invaded and devastated by an armed militant force. Mr. President, it does not require a foreign country to commit terrorist acts on American soil. Terrorist acts can be committed by federal, local, and private entities that are operating under the guise of “protecting the public.”

May your legacy be that you had the valor to be a protector, defender, and fighter against all odds in behalf of the innocent and unpopular,

I would say that it's clear that the FLDS feel they, an American community which has been invaded and devastated by an armed militant force * are under attack similar to war.

And far from innocent to the ways of the world. Putting that UN resolution on their site may have been, at least in part, in response to people mentioning the UN in connection with the alleged abuse of women.
