12-year-old faces murder charge in friend's stabbing

WACO — A 12-year-old boy accused of stabbing his 14-year-old friend to death with a steak knife during an argument is being held on a charge of murder.

Keith Dancer, who was stabbed in the heart, died Friday. Authorities had arrived at an apartment complex about 12:30 a.m. and tried resuscitating the boy until an ambulance came, McLennan County officials said in a statement.

Nine children, including the suspect and victim, were inside the apartment with no parents present at the time of the stabbing.

Neighbors David Major, 31, and Marlena Palacios, 24, heard the fight and rushed to tend to the victim.

"(The 12-year-old) was just repeating over and over that he was sorry and didn't mean it," Palacios told the Waco Tribune-Herald.

Police said that after a verbal fight turned into a fistfight, the 12-year-old went to the kitchen for a knife and stabbed his friend. Neither the suspect nor the victim lived at the apartment.

The 12-year-old is being held in the McLennan County Juvenile Detention Center.

Tim Savoy, a spokesman for the Texas Youth Commission, said that a 12-year-old murder suspect is "very rare."

Age 10 is the youngest a child can be charged in the state.

At 14, a child can be tried as an adult in a capital murder case. At 17, the child is automatically tried as an adult.

Texas is tough on criminals. Sheesh just look what they did to the FLDS children and parents....and they're not even criminals! Texas is tough, period.

I find it a bit crazy to think a 10 year-old, under Texas law, is supposedly emotionally and intellectually capable of forming the intent to commit 1st degree murder, yet a 16 year-old isn’t emotionally or intellectually capable of saying "yes" to sex.
Damn it All!!!!
