On February 10th, 2009, the Minister of the Interior released the results of the formal Inquest that had been requested by Green Party members of Parliament. Below is an unofficial translation of the Inquest results. As stated previously, the police were given the list of 39 questions to reply to. To no one’s surprise, they have cleared themselves, even though their answers bring more discrepancies and questions.

Regarding question 4: How many persons were interrogated altogether by the responsible Investigators in this connection?

Based on the case record, written statements were taken from 7 persons regarding the matter; information was obtained by telephone from another 10 persons.





Regarding question 5: How does police get the opinion, that a positive HIV-Test can be a motive for suicide, if such an actual test was part of the belongings of the missing person and was conveyed to police afterwards again?

There is no indication in the record that the investigators considered a positive HIV test, if there was one, as the reason for suicide by Mr. Gillern.





Regarding question 6: How do you explain for yourself the fact, that Aeryn Gillern verifiably used his phone after 19:00, which remained in the Sauna, although he is said to had left the Sauna already before 19:00?

The assumed time of the argument in the sauna as well as of the departure from the sauna is based on the statements made by several witnesses. Since the missing-person report was filed on Nov. 1, 2007, three days after the incident in the sauna, and only at this time could a connection by name be made between the unknown man in the Danube Canal and Mr. Gillern, the time of departure from the sauna could no longer be determined exactly, since the witness statements diverge. For the 7:00 PM time (supposed time of departure from the sauna) it is therefore a matter of the earliest possible time according to the witness statements. One witness gave 7:30 PM as a possible time in answering the investigators’ questions. Eyewitnesses report having noticed a naked man running toward the Danube Canal at about 8:00 PM (see also answer to question 36). The telephone call of the witness who noticed a man drifting in the Danube Canal (see also answer to question Cool took place precisely at 8:21 PM.

Wien, 08. Juni 2009 Ein 17-jähriger Wiener sprang mit Freunden immer wieder in die Donau. Als er nicht mehr auftauchte, alarmierten die beiden die Rettung. Der Bub konnte nur mehr tot geborgen werden.

Ein Jugendlicher ist am Sonntagnachmittag bei einem Sprung in das Donau-Entlastungsgerinne in Wien-Floridsdorf ums Leben gekommen. Der 17-Jährige war gegen 14.30 Uhr mit zwei Freunden in der Nähe der U-Bahn-Station "Neue Donau" von einem Schwimmsteg ins Wasser gesprungen, so die Polizei.

Nachdem der 17-Jährige nicht mehr auftauchte, holten seine Begleiter Hilfe. Die alarmierten Feuerwehrtaucher konnten den Burschen nur mehr leblos bergen, sämtliche Wiederbelebungsmaßnahmen blieben ohne Erfolg. Ob der Jugendliche beim Sprung tödlich verunglückte oder ertrank, soll eine Obduktion klären. Derzeit wird als Todesursache eher eine Verletzung angenommen.

Zu einem ungewöhnlichen Einsatz ist am Samstagvormittag der ÖAMTC-Notarzthubschrauber Christophorus 9 gerufen worden: Beim Kraftwerk Freudenau war ein Mann seinem Hund in die eiskalte Donau hinterhergesprungen, woraufhin beide nicht mehr aus dem Wasser kamen.

Fast 30 Minuten lang habe der Mann vergeblich versucht, gemeinsam mit Hund ans Ufer zu gelangen, bis seine Begleiterin schließlich die Rettungskräfte alarmierte. Gemeinsam mit der Feuerwehr, der Rettung und der Polizei gelang es der Hubschrauberbesatzung, den stark unterkühlten Mann mit einem Tau aus den Fluten zu retten. Auch für seinen vierbeinigen Begleiter nahm der Rettungseinsatz ein gutes Ende.

Unterkühlung
Der Hund habe sich mit letzter Kraft an sein Herrchen geklammert und konnte gemeinsam mit ihm am Tau hochgezogen werden, berichtete der Pilot. Der völlig erschöpfte und stark unterkühlte Mann wurde von der Rettung ins AKH gebracht.

Während sich der Freund in Ufernähe noch mit einem Nachbarn unterhielt, ging der 31-Jährige bereits ins Wasser und ertrank. Er konnte von seinen Freunden nur noch tot geborgen werden.

Der Vorfall ereignete sich gegen 6.30 Uhr am vergangenen Freitag im Bereich der Berchtoldgasse. Nachdem der Gastgeber den 31-Jährigen an der Donau nicht mehr sah, dachte dieser, er sei bereits wieder zum Haus zurück. Regarding question 1: Are investigations still pending, or is the file closed?
Investigation in this case is ongoing.


Regarding question 2: How is the probable course of events of the disappearance of Aeryn Gillern to your perception?
Based on the case record, the course of events was as follows:
Mr. Gillern got into an argument with another sauna guest between 7:00 and 7:30 PM on Oct. 29, 2007. The argument started when the other guest asked Mr. Gillern how he was. Subsequently Mr. Gillern, suddenly and for no apparent reason, ran outdoors naked from the sauna. Later two eyewitnesses were found who saw a naked, bald man (evidently Gillern) running through the 1st District of Vienna toward the Danube Canal. Shortly thereafter a fisherman on the Danube Canal at Hermann Park in 1030 Vienna [3rd District, adjacent to 1st District] noticed a bald man drifting in the water there, who called for help and then sank in the water. It can be assumed with a probability verging on certainty that the man drifting in the water was Gillern.


Regarding question 3: Did the investigators tasked with this case check out the rumors according to which there was an argument in the sauna before the disappearance?
Yes.

Sending of several patrol vehicles−Anton 1, Anton 2, Anton 650, Theodor 94−notification of the fire department and the diving squad as well as the rescue service.


Regarding questions 12-14: Did a search with divers take place? , Which unit did execute the search? , How many divers were on duty and how are their (personal-)numbers?
No; according to the fire department, a diver operation was not possible or else did not seem sensible because of the strong current.


Regarding question 15: From when to when was the mission executed?
Specifically from 8:21 to 9:21 PM; further search measures continued after that.


Regarding question 16: In which area was the mission executed?
Site of operation: Vienna District 1, beginning at Uraniastrasse No. 1; after that, downstream, searching on both banks of the Danube Canal (site of operation: confluence of the Vienna River with the Danube Canal).


Regarding question 17: For which reasons was the mission stopped without results?
On account of the strong current prevailing at the operation site, further searching was judged to be hopeless and therefore terminated.


Regarding question 18: Who made this decision?
Primarily the head of the Leopoldstadt firefighting squad (badge No. 9017).


Regarding questions 19 and 20: Where there search-dogs in addition to the divers? , If yes: which traces were searched for?
No, since there were no indications calling for deployment of search dogs. A possible connection with the missing person was made only after the missing-person report was filed on Nov. 1, 2007.


Regarding questions 21 to 24: Did further searches take place in this case since the search of 29th oct.2007? , If yes: of which kind were these searches? , When did they take place? , With which result?
Besides the search operation on Oct. 29, 2007, no other targeted or coordinated search operations have taken place. Nonetheless, the office in charge of the case (now the Landeskriminalamt Wien [Vienna State Detective Bureau], East Branch) initiated an alerting of the regular police units (city police squads 1, 3, 11, and 20 and the Division for Special Units). This did not affect the investigative activity of the Landeskriminalamt Wien, East Branch; unfortunately, however that activity did not provide any concrete leads or starting points for a further planned search operation.


Regarding question 25: Was there contact with other Danube-neighbouring countries concerning the probable finding unknown drowning victims?
A notice was issued in accordance with the regulations for searches and requests for information (EKIS-SIS). To follow up the search activities, a special notification was undertaken, via Detective Headquarters 1, of the Danube riparian states. The Bundeskriminalamt [Federal Investigative Bureau] initiated a worldwide Interpol search regarding the disappearance of Gillern, including his DNA profile.


Regarding questions 26 and 27: Was there a cadaver of an unknown drowned person found meanwhile, that could be Aeryn Gillern? , If yes: was the mother of the missing informed of this fact?

According to the case record, no such corpse has been found.


Regarding questions 28 and 29: Were there handed out copies of the file in this case to the mother of the missing person? , If not, why not?
According to the case officer’s report of the facts on March 5, 2008, the mother was not given a copy of the case record because the legal basis for this was absent (official action in accordance with the Sicherheitspolizeigesetz [Law Regulating the Police]).


Regarding questions 30 to 32: Are the accusations of the mother concerning the non-cooperative and of presentiments against gays characterized behaviour of the investigating officials appropriate? , If no: which investigation-measures were set to verify these reproaches? , If yes, which disciplinary measures were set until now, or will be in future concerning this non-appropriate behaviour.
According to the communication from the State Police Headquarters in Vienna, which is in charge of the case, the investigative officials deny engaging in such behavior. The checking of the accusations in this regard is not yet concluded; up to now, the State Police Headquarters in Vienna sees no cause for disciplinary or administrative-law measures.
In regard to possible relevance of the accusations on file in terms of criminal law, I can report that on Nov. 24, 2008, the Büro für besondere Ermittlungen (BBE) [Office of Special Investigations] of Federal Police Headquarters in Vienna received the Gillern complaint file in question. Based on this file, that Office has begun to undertake inquiries accordingly (consulting the original records, contacting the officials responsible for the investigation of the missing-person case in question, etc.) These inquiries have not been concluded. The Vienna State Prosecutor’s Office will receive a final report on this matter in any case.


Regarding question 33: Is there a connection of the approach of police to the case with the letter of complaint Aeryn Gillern wrote to AI, in which he complained about inappropriate, brutal treatment by policemen on the occasion of a ticket-control on 11th Jan 2003?

No.


Regarding questions 34 to 36: Can you exclude that Aeryn Gillern was victim of a violence-crime? , If yes: based on which facts and proofs? , If no, which further investigational negotiations will be held, to be able to exclude a violence-crime in this case?
No. Investigation has yet to be completed of all the substantive circumstances that could contribute to a clarification of the case.


Regarding questions 37 and 38: Do you think the procedure of the police is appropriate in this case? , Do you think the procedure of the police in this case is favourable for the picture of Austria in the world?
According to the reports received, it can be assumed on the basis of the case record that proper procedures were followed in relation to both the operation on Oct. 29, 2007, and the processing of the file on the disappearance. In other respects, let me refer you to the answer to question 30. Apart from that, opinions and views are not the subject of parliamentary interpellation law, according to Art. 52, B-VG [Federal Constitutional Law]. [Translator’s note: The “opinions and views” would be in connection with a question about the effect of procedures in this case on Austria’s image in the world.]


Regarding question 39: How do you want to assure in the future, that relatives of missing persons, no matter if Austrian or from abroad, come across in forthcoming, compassionate, and comprehensible manner?
Independent of the case at hand, I may point out that the Bundeskriminalamt has been given a relevant project tasking that concerns dealing with interested parties in connection with cases of disappearance. In connection with that, training content is to be developed accordingly.

There are two different spellings of Aeryn's last name:

The American version: Gillern

And the Irish version: Gilleran
which he used while living in Vienna.

SPCA Lowers Adoption Rates In Hopes of Finding Homes for Cats

The Cortland SPCA is having a hard time adopting the nearly 200 cats seized two months ago from an overcrowded cat clinic. While some had to be put down because they were too sick, the rest are ready for a new family. But, only about 20 cats have been adopted so far. In the meantime, they’re staying at the old Cortlandville Fire Department. Cortland County SPCA Executive Director Kathy Gilleran says the adoption process has been slow. She’s hoping it picks up soon and that all 200 of them find homes by Christmas. All of them have been tested for illnesses and are healthy enough to move on. She’s even willing to open the adoption up to people living outside of Cortland County. Because they have so many cats, the Cortland County SPCA has reduced the adoption fee from $85 to $10. Anyone who is interested in giving one of the cats a new home should call the SPCA

A suicide attempt is a clear indication that something is gravely wrong in a person�s life. No matter the race or age of the person; how rich or poor they are, it is true that most people who commit suicide have a mental or emotional disorder.

The most common underlying disorder is depression, 30% to 70% of suicide victims suffer from major depression or bipolar (manicdepressive) disorder.

Warning Signs of Someone Considering Suicide

Any one of these symptoms does not necessarily mean the person is suicidal, but several of these symptoms may signal a need for help:

� Verbal suicide threats such as, �You�d be better off without me.� or �Maybe I won�t be around.�

� Expressions of hopelessness and helplessness.

� Previous suicide attempts.

� Daring or risk-taking behavior.

� Personality changes.

� Depression.

� Giving away prized possessions.

� Lack of interest in future plans.

Remember: Eight out of ten suicidal persons give some sign of their intentions. People who talk about suicide, threaten to commit suicide, or call suicide crisis centers are 30 times more likely than average to kill themselves.

Suicide and Adolescents

Over the past 60 years, the overall rate of suicide among adolescents has tripled making it the third leading cause of death among 15-to-25-year-olds and the second leading cause of death among college students.


It�s important for parents, teachers and counselors to become familiar with the facts about teens and young adults, especially when it comes to depression and suicide. When teens� moods disrupt their ability to function on a day-to day basis, it may indicate a serious emotional or mental disorder that needs attention - adolescent depression. Sometimes teens feel so depressed that they consider ending their lives.

Studies show that suicide attempts among young people may be based on long standing problems triggered by a specific event. Suicidal adolescents may view a temporary situation as a permanent condition. Feelings of anger and resentment combined with exaggerated guilt can lead to impulsive, self-destructive acts.

Suicide among adults is uncommon as opposed to teens. However, suicide often occurs from the preceding of depression. Many people die by suicide because depression is triggered by several negative life experiences, and the person does not receive treatment, often having the outlook of life to be dull and pointless. This long-running emotion usually climaxes at the stage of suicide.

These ares some of the few reasons one may commit suicide:

* The death of a loved one.

* A divorce, separation, or breakup of a relationship.

* Losing custody of children, or feeling that a child custody decision is not fair.

* A serious loss, such as a loss of a job, house, or money.

* A serious illness.

* A terminal illness.

* A serious accident.

* Chronic physical pain.

* Intense emotional pain.

* Loss of hope.

* Being victimized (domestic violence, rape, assault, etc).

* A loved one being victimized (child murder, child molestation, kidnapping, murder, rape, assault, etc.).

* Physical abuse.

Letter to Police Chief


This is the letter I wrote to the Police following my last meeting
with them the first week of December 2007.



Chief Tikal,


Twelve weeks ago yesterday my son disappeared. On Wednesday it will be twelve weeks since I received the phone call that would change my life forever.

I am feeling no less frustrated, anxious, angry, sad,numb, confused, then I was 82 days ago when I first received the call from UNIDO stating my son was missing.

I will start by apologizing for not writing you earlier to thank you for taking the time to meet with me and listen to my concerns. I felt that you were sincere, and not putting on an act for my benefit. You had all the qualities that I had expected from the Investigators in your Department. You made me feel comfortable with the way that you spoke to me, your willingness to make eye contact with me, and your physical gestures all relayed that you were definitely interested in what I was saying. You showed empathy which, prior to our meeting, I had not experienced from your Police Department, and I feel you were honest in your responses to me. You never became defensive, but truly listened. I was, and remain, impressed and grateful to you.

Having said that, I am still very angry, shocked, and saddened, by the way I was treated by the Investigators assigned to this case, especially Mr. Weiss and Lt. Haimeder.

I have avoided writing this for several weeks as I fear that my speaking out will hurt the investigation of my son's disappearance, by making members of your Department angry.

After several weeks I have come to the conclusion that nothing can damage the investigation anymore than it already has, and that as a mother I have the right to demand justice as well as the moral responsibility to speak out.

Since I have been home I have met with and spoken to numerous law enforcement officials.

I have relayed to them the circumstances of my son's disappearance, as well as the response, or lack thereof, of the Vienna Police Department. None seem to understand why there has not been more of a push to find out what happened at the Kaiserbrundl that evening, and all are aghast at the way I was treated. They also don't understand why friends, family members, people from his job, or anyone that knew my son were not interviewed.

I have also spoken to numerous Mental Health experts, Psychiatrists, Psychologists, etc. who have never heard of "Spontaneous Suicide", and don't believe that running naked from a building for numerous blocks and jumping into a river would ever be considered "spontaneous". They
also don't feel that my son would have been planning for the future, for example purchasing groceries items, plane tickets, doing laundry, dropping off dry cleaning, etc, if he was planning on committing suicide. They also ask what happened to him at the sauna.

I met with, and spoke with, over 50 of his friends and co-workers while in Vienna, and have received e mails from many others since my return. None of them believe that he committed suicide. I have not heard one single person in Vienna, or here in the states, who knew my son
through his job at UNIDO, or socially through his courses at Webster University, the gym etc., including his Doctor, say that they felt his was depressed, overwhelmed, suicidal.

Not one person!

Just the opposite, everyone talks about his love of life, his plans to do more traveling, his plans to work on another Masters Degree from Webster University, his goals at work, his love of his family.

On October 21st I spoke with him for over an hour on the phone. We talked about my coming to visit him for the Christmas Holidays, and also about me selling my house and coming to stay with him for a couple of months before I bought a new house. On October 27, we spoke again
briefly, when I called to update him on the status of my selling the house. My son had also spent 10 days visiting me at my home in September 2007, during which time he shopped for clothes and shoes to take back to Vienna.

While I was in Vienna I had the opportunity to meet with my son's Doctor, Michael Moser, Kratochwjestr. 8/5/1. Dr. Moser stated that he knew my son very well, had seen him the week prior to his disappearance, and said that my son was not suicidal. He went on to say that my son talked about taking additional courses through Webster University, and talked about traveling.

In other words, as the Doctor put it, my son talked about the future.

I stress this, as the Investigators theory for some time was that my son had received bad medical news and that is why he he ran out of the sauna. You may not be aware of this,but in my son's belongings, that the Investigators had picked up from the Kaiserbrundl on November 1, 2007, was the Lab Results from my son's blood work. The Lab Results were dated October 29, 2007, the day he disappeared. The lab results were all negative. I have attached a scan of this document.

On November 6, 2007 at approximately 13:30hrs. I was given my son's possessions by Investigator Weiss in his office in the presence of UN Security, LT. Onstein. I did not go through everything in his bag at that time as I was extremely overwhelmed and sat on the floor holding my son's clothing and the crucifix that he always wore attached to his trousers. But, at that meeting Inv. Weiss said that my son had committed suicide because he was "HIV positive" and that my son had received the results the morning he disappeared. This was relayed to me
by Lt. Onstein . It wasn't until late that evening when I was back at my son's apartment that I was able to go through his belongings, and at that time I found the lab results that had been with the police for 5 days. Didn't they bother looking through his belongings to see if there were any clue to his disappearance? If you thought that someone committed suicide wouldn't you look for a suicide note?


As I told you during our meeting this was also the day that Inv. Weiss decided to deliver the news that my son was "violent". This was after I had sat on the floor crying uncontrollably while holding my son's belongings and had to be helped to my feet by Lt. Onstein. As you and I
both know Inv. Weiss has since retracted that by saying that he had the wrong information.

I can not get over the insensitivity of this man to tell me something that he "had heard", and especially having sat there and watched me emotionally devastated. This was intentional and was sadistic. I watched the expression of Lt. Onstein and know that afterwards his demeanor had changed. Thanks to Inv. Weiss, Lt. Onstein walked out of that meeting believing my son was violent, and I walked out knowing that I would probably never know what happened to my son, as the people I was suppose to be able to trust, were not to be trusted, and would resort to saying anything to demean the value of my son.


The following week my younger son, Mrs. Radix and myself met with another Investigator. On that day Lt. Haimeder sat in on a meeting with an Investigator whose name I don't know, Lt. Haimeder was extremely defensive yelling at me asking me why I was uncooperative. This was
in response to me asking the UNIDO translator, Psychologist Angelika Radix, what the Investigator was saying to her. Lt. Haimeder also yelled at my son and slapped him on the back of his head, not hard, but he had no right to touch my son. My son had said nothing, he had lit a cigarette, which he thought was okay as the other Investigator in the room was smoking.

As in the three meeting that I had with your Investigators, the Investigators would speak in German often for several minutes and then the translators would get an opportunity to speak for a short time before they would be cut off by the Investigators speaking in German again. I
found this extremely frustrating, as I am sure you understand. As you'll remember at the meeting I had with you, you were very clear that if you found it necessary to speak in German that you would speak briefly and allow for it to be translated fully before you spoke again. It became obvious to me that the Investigator was not letting Mrs. Radix speak, as she also said this to me, and I starting crying from frustration. At this point Lt. Haimeder yelled at me from across the room asking me why I was being uncooperative. I told him I was not uncooperative that I was frustrated, sad, overwhelmed, scared etc. but not uncooperative.

At that point Lt. Haimeder came and sat directly in front of me attempting a different approach, and that is when he explained to me that there were two different kinds of suicide, pre-meditated and spontaneous. I told him that I had never heard of spontaneous suicide. He then asked what kind of police officer I had been. I didn't understand what he meant and told him that. He then said "were you a traffic lady or parking?". I found that insulting,but did not react and simply replied that I had been the head of the Neighborhood Police Unit. He responded that that was why I didn't know about suicides. What I didn't say to him, as I did not feel there was a point, was that during my 21 years on the job I had also been assigned to work in the Criminal Investigation Unit in investigating several Homicides. My police department does not have a separate Homicide Division.

Also during that meeting the I had Mrs. Radix ask the Investigator if they had checked my son's phone while they had it prior to giving it back to me on November 6th. The Investigator told her that they did not check the phone and asked to see it. I gave him the phone, and he then went through my son's SMS messages, which were in English, and told us that it was clear that my son was cheating on his partner. He made this statement as he saw that the messages were from "Fin-Yes!!Austria!" and "Fin-No!Schweiz!!!". He decided that they were 2 different people and that my son was having an affair, thus that is why he committed suicide. I tried to explain that they were both the same person, his partner P., who used one phone # when he was visiting in Austria and the other # when he was at home in Switzerland. The Investigator was not interested in listening to me and at one point when he was having difficulty translating the SMS text I reached for the phone and he slapped my hand. This was an Investigator who said that he did not speak English, who was now translating text that was written completely in English.

As you know, I never had any meetings or conversations with any of your people without a staff member of UNIDO present. I mention that to confirm that my relating of the facts can be substantiated by other people, and more importantly people that speak German fluently.

Your Investigators tried to say that my son had two identities and had two passports. That is not true, as I told you, my son legally changed his name, on his birth certificate, Social Security card, Drivers License and Passport. I have his cancelled passport and the changed one. They were done legally in the US and in Austria. People did call him Mike and Michael, it was his middle name. Is that a crime? Even when I showed your Investigators all his documents they insisted on saying to the translators that he had two identities.


Here are the facts of what happened prior to my son's disappearance. On October 29, he accompanied his partner P. to the airport. He received his Lab results which were all negative for HIV. He went back to his apartment to put in a load of wash. He went to work, spent time with numerous co-workers, spoke to and saw his trainer from Holmes Place, spoke via phone to other friends. He shopped at the commissary at the UN at 16:15hrs on October 29th, and purchased baking paper and bottles of vanilla extract, among other items. The baking paper and vanilla extract were in his bag left at the sauna. The other items, Doritos, were in his office at UNIDO. He signed out of work at 18:00hrs on October 29th, after being at work all day. A copy of the sign in/sign out log is also attached.

I have also attached scanned copies of Air Berlin reservations that my son had made, and purchased, some as recent at October 22, 2007, for flights to visit his partner in Zurich, where he lived and worked. And another to visit his partner in Finland, where his partner's family lives. these are only a few that I have scanned. I find it extremely odd that someone who doesn't want to live would make plans for the future such as these.

My question on 10/31/07 was and continues to be, what happened at the Kaiserbrundl on October 29, 2007? I know from being inside the sauna myself, having been taken on a tour of it on December 6th by the manager, that there are video cameras. Why weren't the tapes ever taken and or at least viewed by the Police? Why was the guest list never checked? The manager and co-manager both initially reported there had been a fight between my son and a tourist, and the tourist supposedly went to the hospital. They also said that it happened at 22:00hrs not 19:00hrs and that they called the police but the police didn't come. There is also no record of that at your call center. Isn't that suspicious, and a three hour time difference is a lot of time.


What I have been told by your Investigators is that, at exactly 1850 hours, on October 29, 2007 my son was sitting downstairs in the sauna with his eyes closed, listening to his music, with his headphones on, when he was tapped on the shoulder by an unknown person. He then, according to your Investigators, panicked, and ran from downstairs in the sauna, up the stairs directly pass his changing room where his clothes, wallet, and all his personal belongings were, and out the door with just a towel on. The manager showed me his changing room, which was directly at the top of the stairs. And strangely enough on November 6th, 2007, when I was given my son belongings back by Investigator Weiss, my son's music player and headphones were in his backpack in the bag. How did that happen? His music player was on an armband, did he rip it off, throw it and run outside? I don't think so. By the way, it works, it is not broken.

Did your Investigator Weiss tell you that my son sent an SMS at 1927hrs on October 29, 2007 to his partner, and that it is still on his phone?

Did Investigator Weiss also tell you that a friend of my son, Arnissa, called and spoke to him at 1930hrs, October 29, 2007 for approximately 10 minutes?

With the treatment and discrepancies in what I have been told, I believe it is apparent why I do not trust that my son's disappearance will ever be solved.

On November 3rd I was told by Investigators, through a UNIDO interpreter, that the canal was being patrolled daily by Police Boats looking for him. The day that I met Lieutenant Haimeder and asked about the boats searching for my son, I was told by him, that there were no boats searching the canal, that it would be a very expensive thing to do and he would not authorize it.

As I told you on the day that we met, I was given, what I believe to be credible information, that contrary to what may be in the report, that scuba divers were not dispatched to the canal on the evening of October 29, 2007 as I had been assured by Inv. Weiss. Honestly I find it hard to believe that logistically that a team of divers could be dispatched sometime after the alleged call from the fisherman at 20:20hrs, arrive set up, search and clear at 20:50hrs. I am sure they are efficient, but that time frame is unrealistic.


The alleged call from the fisherman is extremely puzzling. I find it extremely unlikely that police working out of the same precinct or district would not have some idea of a major incident happening. According to Investigator Weiss, on October 29th, 2007 at 2020hrs. after the fisherman called, the fire department, canine unit and scuba divers all responded to the Danube Canal. On October 30, and October 31 2007, my son's partner and his upstairs neighbor went to the district or precinct office that Investigator Weiss works to report my son missing. They went with a picture of my son, with his shaved head, but the police would not take a missing person report and did not find it coincidental that there was a bald man missing, even though they were shown his picture, and that the police were investigating a bald headed man in the canal? I find that extremely unlikely that they would not have heard of this case, if indeed it had happened.


The fisherman story also changed several times while I was in Vienna. Initially Mr. Weiss said the fisherman saw a "bald headed man", then it became a body floating, then it became a scream and a splash, and by the time I left it was a scream.


I went to the spot where the fisherman supposedly was. It is clearly a place where people drink and do whatever they don't want to be seen doing, and clearly not a place to be fishing at 2020hrs.


As you know from our meeting, Investigator Weiss gave you a report that he filed on "his interview" with me. From what I could see, it was a rather lengthy report. As I told you at that meeting Investigator Weiss NEVER spoke to me or interviewed me, and as you will recall when you asked him about it you said that his response, as he sat across the table from me was "well I was mistaken, it was someone else". How does that happen? Who did he interview and put the report in my son's file? We both know that he lied about my son being "violent". What else has been lied about? We both also know that he speaks English as he displayed quite well when he demanded to know who told me that there were no calls for the scuba team the night of October 29, 2007.


Prior to my leaving Vienna I had people contact the newspaper that printed that my son was "emotionally unbalanced". The newspaper stated that all their information came from a police source not the UN as Inv. Weiss indicated during our meeting. Another lie.


In closing, my son is American, Homosexual, and was known to frequent a Homosexual Sauna, the Kaiserbrundl. Your Investigators know from interviewing my son's partner on November 3rd that my son was "Mr. Gay Austria". My son also filed a complaint against the Police Department in 2003 regarding an incident with the police that occurred January 11, 2003. Although I would hope that in a civilized society that none of these statements would affect the course of an investigation, I am not naive enough to believe that it wouldn't. I was a Police Officer myself, and know that personal feelings and prejudices do creep in on even the most professional of officers.


Having experienced the lack of professionalism, insensitivity, rudeness, bullying, and outright lies from a small number of your police force, albeit, and unfortunately, the ones assigned to my son's case, it is no wonder that I do not trust that this case is or has been handled properly.


Regardless of your Investigators personal feelings or opinions about my son's personal life and sexual orientation, my son was a guest in your country. Not a criminal. Not a burden to your economy. Not a threat to you or anyone else. He was a hard worker who loved his job, had an unending thirst for education, prided himself on staying physically fit, and was proud of who and what he was. He kept his private and professional life separate, which as far as I know is not criminal or suspicious, as I have been led to believe by your investigators.

I also was a guest in your country. A guest that was experiencing the worse fears that a parent can have, and I was treated in a manner I can only term sadistic.


I ask you or anyone else in your department what you would expect from a police organization if a child of yours was missing. I believe that you would expect and demand no less then what I am asking for, and that is far more then I have received thus far.

Vienna 2009

After hearing that the Viennese Police had cancelled the meeting that was set for October 29 at 2:30PM, I actually considered canceling the trip. I did not want to do that as I had made a promise to be there every October 29th for Aeryn. Thanks to Gretchen Morning, who provided me with a video camera, I also had another purpose, to film the Vienna Aeryn loved, and attempt to get people to talk to me on video.


As I was not traveling with professional video equipment you may notice some graineyness in some of the video used in the trailer. The quality of the finished documentary will be much clearer then this, although some of the original interviews that I did might retain this. Aeryn’s story is real and the path to the truth has been shrouded with lies and constantly changing stories. The film quality to me, gives it reality


I spoke on the phone with Lt. Kovar on October 30th. I have met with him on two previous trips. He speaks English, but at my last meeting with he and General Maher, he would only speak German. I again asked to meet with him or some representative of the Police Department. Lt. Kovar told me that he had already told my friend in Vienna that he was too busy to meet with me, and that “... everyone else was too busy...” to meet with me.


I stated to him that I was asking for 15 minutes, face to face. I told him that I believed that any Police Department in a civilized country would grant the family of a missing person face time once a year. I reiterated that I was there for two weeks. He replied that there was not a moment of time to meet with me, and did not see that it was necessary as the police are “... not doing anything on your son’s case.” I asked if Aeryn’s case was still open, he replied it was.


I then asked him what had been done with the DNA swab that they had done on me October 30, 2008. He told me that they still had it. I reminded him that the purpose of obtaining the swab from me was to amend the information that the police had submitted to Interpol, 8 months after Aeryn disappeared. Lt. Kovar told me there was no need to do that as Investigator Weiss had removed a toothbrush and underwear from my son’s apartment on November 1, 2007. I reminded him that we had already determined that Investigator Weiss had lied about taking any evidence from my son’s apartment as there were two other witnesses aside from myself there, and that we had discussed this at every meeting I had with the police department.

He replied that the DNA sample submitted to Interpol was not going to be amended. I told him that I would be back next year, 2010 for the 3rd year of my son’s disappearance and would expect a meeting. Lt. Kovar responded that they would be too busy then also.


On the bright side, I had the pleasure to meet with the new Counselor for Consular Affairs Heather Graimund (sp). She spent over an hour with me, in a private office rather then subjecting me to sitting in public as Constance Anderson, former Counselor, had done on November 4, 2007. Although I realize she is still restricted as to what she can do to assist me I felt that she was empathetic to my situation, and I was pleased with the meeting.


I want to thank all of Aeryn’s friends, who are now part of my extended family for taking care of me while I was there. For making me smile, for giving me hugs, for making sure I ate, and went on very long treks, for caring and believing in my continued fight for Aeryn.

Special thanks to those who had the courage to talk to me on camera. Your courage inspires me.
