HLN The judge has set George Zimmerman’s bond at $150,000 with conditions; he will not be released today. He will be electronically monitored and has to check in every three days. We will have more details up on hlntv.com/trayvon.

George Zimmerman surprised a Florida court today by taking the stand and apologizing to the parents of Trayvon Martin, who were sitting in the courtroom during Zimmerman's bond hearing.

"I am sorry for the loss of your son. I did not know how old he was. I thought he was a little bit older than I was," Zimmerman said addressing Martin's family directly.

Zimmerman took the stand wearing a dark suit with his hands shackled to a belt around his waist.

His surprising testimony came the same day that ABC News exclusively obtained a photograph showing the bloodied back of Zimmerman's head, which was apparently taken three minutes after he shot and killed Martin. The photo could give credence to Zimmerman's claim that Martin had bashed his head against the concrete as Zimmerman fought for his life.

The bond hearing concluded this morning with Judge Kenneth Lester agreeing to allow Zimmerman, who is charged with second degree murder, to post a $150,000 bond to get out of jail. The prosecution had argued that Zimmerman should be denied bail or that it should be set at $1 million.

With ABC News’ release of the George Zimmerman photo showing blood flowing freely from his head, the question becomes whether Angela Corey, the prosecutor in the case, had access to the photo before charging Zimmerman with second-degree murder.

The arrest affidavit did not mention the photograph, or the bleeding, gashes, and bruises on Zimmermans’ head. Professor Alan Dershowitz of Harvard Law School stated upon release of the arrest affidavit that it was “so thin that it won’t make it past a judge on a second degree murder charge … everything in the affidavit is completely consistent with a defense of self-defense.”

Dershowitz continued, “An affidavit that willfully misstates undisputed evidence known to the prosecution is not only unethical but borders on perjury because an affiant swears to tell not only the truth, but the whole truth, and suppressing an important part of the whole truth is a lie." When asked if it made a difference whether the prosecution had the bloody photograph at the time they charged Zimmerman, Dershowitz responded, “We do know that there were earlier photographs before the affidavit was done that strongly suggested blood on the back of the head, and we know the police had first access to him, so if there was blood they [the prosecution] would know about it …

"I've had cases in Florida against prosecutors,” Dershowitz said, “and this is not the first time they have willfully omitted exculpatory evidence. It's a continuing problem. Here, it’s not only immoral, but stupid. The whole country is watching. What do they benefit from having half-truths in an affidavit?"

Dershowitz added, "I'm not taking sides, but I'm insisting that both sides play by the rules, and so far the prosecution is not playing by the rules."

O'Mara skillfully changed a probable cause hearing into a mini-trial getting things in (like the apology) and casting doubt on the State's probable cause and humanizing Zimmerman.

Mr. Dershowitz does not have the info the prosecution has.
Maybe he should wait and comment till the documents are there to read them.

That pic. might be fake.
The police did not take that pic., an "unidentified person" took the pic.
Just because ABC deceided to publish this pic., on the day of the bondhearing, means nothing.

Also this was a bondhearing, not the trail. exculpatory evidence is not needed at a bondhearing.
And yes, Mr. Dershowitz is taking sides.

(CBS News) SANFORD, Fla. -- George Zimmerman was granted bond of $150,000 Friday in the death of Trayvon Martin. Zimmerman is charged with second degree murder.

Zimmerman was granted bond at a hearing Friday because Seminole County Circuit Court Judge Kenneth Lester was persuaded he was not a flight risk and, despite Zimmerman's killing of Martin, believed he posed no threat to his community.

Lawyers were working out the conditions and security restrictions of Zimmerman's release Saturday, as well as the precautions for his safety. It's possible he could stay outside Florida while awaiting trial. And it's all but certain his location will be kept secret.

He's expected to post bond and leave jail sometime this weekend.

Zimmerman surprised the courtroom Friday -- especially Trayvon Martin's parents -- when he walked to the stand in shackles to apologize for shooting the unarmed teenager.

"I wanted to say I am sorry for the loss of your son," Zimmerman stated. "I didn't know his age. I thought he was a little bit younger than I am. I did not know whether he was armed or not."

A lawyer for Trayvon Martin's family, Benjamin Crump, told "CBS This Morning: Saturday" co-hosts Jeff Glor and Rebecca Jarvis the family is "very disheartened" at the prospect of Zimmerman getting out of jail. He says they found Zimmerman's apology "very insincere" and "self-serving," and they suspect it came with "ulterior motives." Before the family accepts any apology, Crump says, Zimmerman has to tell the truth about what happened when he shot Trayvon because, they feel, he's given numerous different accounts so far. Zimmerman's lawyer, Mark O'Mara, grilled a state investigator on the stand.


Dan Gilbreath admitted under oath that prosecutors had many questions about the shooting they could not answer.


"Any evidence that conflicts, eyewitnesses anything, that conflicts with the contention that Mr. Martin assaulted first?" O'Mara asked.


"As to who threw the first blow? No," Gilbreath responded.


"Do you know who started the fight?"


"Do I know? No."


"Do you have any evidence that supports who may have started the fight?"


"No."

Martin's parents left the hearing without comment, unhappy with Zimmerman's bond and with his apology.

Martin family attorney Natalie Jackson told reporters, "This was the most disingenuous and unfair thing I've seen this was the most unmeaningful apology."

O'Mara insisted to reporters that Zimmerman "had always wanted to acknowledge what happened that day. ... I was hoping it could be accomplished in a private way. We weren't afforded that opportunity."

Wherever he goes, Zimmerman has to meet certain restrictions: No alcohol, no drugs, no guns. A curfew. A GPS ankle monitor. And no contact with Trayvon Martin's family.

The concern over this incident started around the meme of social justice; But as more information has come out about the incident it has become more about individual justice – the individual right to self defense; And about the individual responsibility for the “confrontation” as the charging affidavit referred to. The prosecution’s case ran into trouble last Friday about not knowing who started the fight. That information will be needed by a jury trying to apportion where responsibility, blame or guilt lies.

The next hearing on the case is supposed to be scheduled for next Friday, April 27.

George Zimmerman released from jail on $150,000 bail


SANFORD, Fla. —George Zimmerman was released around midnight Sunday from a Florida county jail on $150,000 bail as he awaits his second-degree murder trial for fatally shooting Trayvon Martin.

The neighborhood watch volunteer was wearing a brown jacket and blue jeans and carrying a paper bag. He walked out staring straight ahead and following another man also carrying bags and didn’t look over at photographers gathered outside. He then followed the man into a white BMW vehicle and drove away.

His ultimate destination is being kept secret for his safety and it could be outside Florida.

Circuit Judge Kenneth Lester said at a hearing Friday he cannot have any guns and must observe a 7 p.m.-to-6 a.m. curfew. Zimmerman also surrendered his passport.

Zimmerman had to put up 10 percent, or $15,000, to make bail. His father had indicated he might take out a second mortgage.

Zimmerman worked at a mortgage risk-management company at the time of the shooting and his wife is in nursing school. A website was set up to collect donations for Zimmerman’s defense fund. It is unclear how much has been raised.

Bail is not unheard of in second-degree murder cases, and legal experts had predicted it would be granted for Zimmerman because of his ties to the community, because he turned himself in after he was charged last week, and because he has never been convicted of a serious crime.

Prosecutors had asked for $1 million bail, citing two previous scrapes Zimmerman had with the law, neither of which resulted in charges. In 2005, he had to take anger management courses after he was accused of attacking an undercover officer who was trying to arrest Zimmerman’s friend. In another incident, a girlfriend accused him of attacking her.

Zimmerman, 28, fatally shot Martin, 17, Feb. 26 inside the gated community where Zimmerman lived during an altercation. Martin was unarmed and was walking back to the home of his father’s fiancée when Zimmerman saw him, called 911 and began following him. A fight broke out —investigators say it is unknown who started it.

Zimmerman says Martin, who was visiting from Miami, attacked him. Zimmerman says he Martin in self-defense, citing Florida’s “stand your ground” law, which gives broad legal protection to anyone who says they used deadly force because they feared death or great bodily harm.

Zimmerman was not charged for over six weeks, sparking national protests led by Martin’s parents, civil rights groups and the Revs. Jesse Jackson and Al Sharpton. Martin was black; Zimmerman’s father is white and his mother is from Peru.

Earlier Sunday, Zimmerman’s attorney was working to secure the money for bail and a safe place for Zimmerman to stay. But residents in Sanford, where Martin was killed, didn’t expect a ruckus once Zimmerman was released.

City commissioners said they hadn’t received calls from nervous residents. Protesters didn’t show up outside the jail. And talk at one local coffee shop seldom focused on the case.

“It’s just kind of a non-issue now,” said Michele Church, a server at Mel’s Family Diner. “That’s pretty much all anybody in Sanford wanted, was an arrest, so it could be sorted out in the court system.”

On Friday, a Florida judge agreed to let Zimmerman out on $150,000 bail. Defense attorney Mark O’Mara has said there are several options for where Zimmerman should go, but would not disclose any of them. Lester on Friday indicated Zimmerman would be allowed to leave the state if arrangements with law enforcement could be made for him to be monitored. He will be fitted with an electronic device.

About a half-dozen photographers and cameramen camped outside the Sanford jail Sunday, focused on the door marked “Bonds Rooms,” where other people who had been arrested and released on bail exited. Zimmerman had entered the jail about a week earlier after more than a month of nationwide protests calling for his arrest.

“The mood in Sanford has calmed down tremendously,” said Sanford Commissioner Patty Mahany, whose district includes the neighborhood where Martin was killed. “I think now that people are able to see the justice system taking place, even though they understand it’s going to be quite slow, people are willing to just remain calm and really we’re all getting back to our daily routines.”

A spokeswoman for the Seminole County Sheriff’s Office declined to release any information about whether they were increasing patrols or security.

Defense attorneys for other high-profile clients who awaited trial on bail have said Zimmerman should leave Florida and refrain from going out in public. Sanford residents say they aren’t expecting to see him around the neighborhood anytime soon.

“They’ve already said they’re going to move him to a safe place,” Church said. “Everyone has calmed down. That’s all anyone in Sanford wanted, an arrest.”

Meanwhile, Martin’s parents published a “Card of Thanks” in The Miami Herald obituary page Sunday. The note says Sybrina Fulton and Tracy Martin express their appreciation for all the public’s support since their son’s death. The notice includes a photograph of Trayvon Martin dressed in a hooded sweatshirt, similar to one he was wearing the evening he was killed.

“Words will never express how your love, support and prayers lifted our spirits and continue to give us the strength to march on,” the letter says.

Task force meets to look at Florida's 'Stand Your Ground' law

(CNN) -- A task force created by Florida Gov. Rick Scott to examine the state's "Stand Your Ground" law in the wake of the Trayvon Martin shooting meets for the first time Tuesday.

Seventeen people will tackle the issue of whether the controversial law should be changed in light of the death of the unarmed teenager.

The task force, whose membership was announced last month, will take testimony at public meetings across the state. The first session will be held in the state capital, Tallahassee.

"We're not walking into this with any preconceived notions," Gov. Rick Scott said at an April 19 news conference. If there are "logical changes to be made," he said, the task force "will provide those."

Recommendations from the group will be passed along to the governor and the Legislature.

The group will review Florida Statute Chapter 776, which deals with justifiable use of force, including the Stand Your Ground provision.

The law allows people to use deadly force when they feel a reasonable threat of death or serious injury. Critics and defenders of the law have argued over just what it allows, when it applies and whether it achieves its intended effect.

George Zimmerman, 28, a neighborhood watch volunteer, fatally shot Martin on February 26. He was arrested April 11 after a lengthy delay punctuated by protests and rallies nationwide calling for charges against him.

Critics accuse Zimmerman of racially profiling and unjustly killing Martin, a 17-year-old African-American. Zimmerman, who is Latino, told police he shot Martin in self-defense, according to police reports.

Although details of the shooting remain murky, it is known that Martin ventured out from the Sanford, Florida, home of his father's fiancee and went to a nearby convenience store, where he bought a bag of candy and an iced tea. On his way back, he had a confrontation with Zimmerman, who shot him.

Zimmerman was recently released on $150,000 bail, 10% of which was put up to secure his release while he awaits trial on a second-degree murder charge in Martin's death.

Lt. Gov. Jennifer Carroll, who is leading the Task Force on Citizens Safety and Protection, said the group is "highly qualified" and includes people from "many different points of view" who are "racially, regionally and professionally diverse."

The task force includes a retired judge, attorneys experienced in both prosecution and defense and members of neighborhood watch programs. Two state representatives are on the task force, one of them the author of the Stand Your Ground bill in the House, Carroll said. The list of 17 members also shows two state senators.

There are no representatives from the National Rifle Association on the task force, Carroll said in response to a question. But the task force will hear from people on various sides of the issue at public events throughout the state.

She said the government did not reach out to people to join the task force, but rather considered people who had contacted officials and said they wanted to be a part of it.

"We're going to engage the entire state of Florida to tell us the pros and cons, how they feel about these laws," said the Rev. R.B. Holmes Jr., who is serving as vice chairman.

Florida's crime rate is at a 40-year low, and "I want to keep it that way," Scott said. "If there's laws that are impacting that, where people don't feel comfortable, I want to know about it."

The list of 17 task force members includes a sheriff, a former Florida Supreme Court justice and a leader of the League of United Latin American Citizens. Both Carroll and Holmes are African-American.

Questions of whether race played a role in the incident have been prominent in the uproar over the case.

Officials hope the task force will complete its work by the time of the state's next legislative session, so changes could be made then, she said.

A member of the U.S. Civil Rights Commission, Michael Yaki of San Francisco, said last week he will ask that agency to investigate such laws.

George Zimmerman's lawyer has signaled that he may seek a dismissal of the second-degree murder charges against his client under Florida's Stand Your Ground Law. NBC's Michael Isikoff reports.

Florida teenager Trayvon Martin died from a single gunshot wound to the chest fired from “intermediate range,” according to an autopsy report reviewed Wednesday by NBC News.

The official report, prepared by the medical examiner in Volusia County, Fla., also found that the 17-year-old Martin had one other fresh injury – a small abrasion, no more than a quarter-inch in size – on his left ring finger below the knuckle.

Separately, a medical report on Martin’s alleged killer, 28-year-old George Zimmerman, prepared by his personal physician the day after Martin’s shooting in Sanford, Fla., on Feb. 26, found that the Neighborhood Watch volunteer suffered a likely broken nose, swelling, two black eyes and cuts to the scalp. That report, first reported Tuesday by ABC News, also was reviewed by NBC News.

Both documents are part of a mountain of evidence – up to 300 pages and 67 CDs of witness statements, surveillance videos and other material-- expected to be made public soon in connection with the second-degree murder case against Zimmerman.

Zimmerman allegedly shot Martin during a confrontation inside the gated community in Sanford where Zimmerman was a neighborhood volunteer and where Martin was visiting his father’s fiancée.

After first reporting a suspicious person in the neighborhood in a phone call to Sanford police, Zimmerman followed the teenager before a fatal confrontation that remains shrouded in mystery.

When police arrived at the scene to find Martin dead on the sidewalk, Zimmerman claimed he shot the teen in self-defense. Zimmerman was treated at the scene for cuts and a bloody nose, then questioned by police for hours before being released without being arrested. Authorities said at the time that they had no evidence challenging Zimmerman's account and that his conduct appeared to be justified under Florida's so-called Stand Your Ground law.

But after questions about possible racial motivation for the slaying – Martin was black; Zimmerman is a white man of Hispanic heritage – a special prosecutor took over the case and, on April 11, Zimmerman was charged with second-degree murder. He was released on April 23 on a $150,000 bond and has been out of the public eye since then.

What does 'shot from intermediate range' mean? It isn't up close like I would expect if there was a physical confrontation between the two.

Not shot with the gun muzzle against the victim. but still close enough to cause powder tattooing, Powder tattoing begins around the 10mm distance - less than a half of an inch.

All Zimmerman had to do was to stay in his car. Call the cops, let them handle it AS THEY instructed, That would never had put himself or Martin in amy danger ~ He chose his own path and rules to kill by. :evil:

George Zimmerman's Bond Revoked

A judge revoked bond today for George Zimmerman, the neighborhood watch captain charged with second-degree murder in the shooting death of a Florida teenager in his gated community, and ordered him to surrender himself in 48 hours.

Prosecutors had filed a motion today to revoke his bond, accusing Zimmerman of "deceiving" the court about his finances and his possession of a second passport, which he apparently acquired two weeks after the shooting.

"The court was led to believe that they didn't have a single penny," said prosecutor Bernie De La Rionda. "If this [the money] wasn't relevant to bond then why did they lie about it? I don't know what other words to use besides that it was a blatant lie."

The judge seemed to agree.

"They were well aware of the money that was available," Judge Kenneth Lester.

In recordings of conversations released today during a court hearing, Zimmerman and his wife, Shelly Zimmerman, cryptically talk about his second passport in a safety deposit box they shared.

Although one of his passports was due to expire in May, prosecutors said today, Zimmerman applied for a second passport, informing the State Department that the original had been lost lost or stolen.

In some of the phone calls between the two, she is at a credit union that was linked to his PayPal account and speaking to a teller. The prosecution said that despite being in jail, Zimmerman was "intimately involved in the deposit and transfer of money into various accounts."

In the conversations, prosecutors say, Zimmerman and his wife speak in code -- reducing the amounts in their financial accounts by a factor of 1,000. Prosecutors said the couple knew that their jailhouse conversations were likely being recorded.

Zimmerman is accused of tracking down and killing teenager Trayvon Martin, who caught the attention of the neighborhood watch captain in his gated Florida community.

The new documents show that Zimmerman had $135,000 in his bank account the day before his bail hearing -- in which he declared himself financially indigent.

Ben Crump, the Martins' family attorney, said that Trayvon Martin's parents had always maintained that Zimmerman should remain in custody until a trial.

"If the shoe was on the other foot, Trayvon Martin would have been put in jail," Crump said.

The prosecution and defense also have banded together against more than a dozen media companies' demands to uncork another batch of sealed records that could reveal much more about both Zimmerman and Martin that night.

The attorneys for Zimmerman and the state will likely try to keep sealed Zimmerman's statements to police, his text messages and the names and addresses of 22 witnesses who saw or heard the fighting between Zimmerman and Martin Feb. 26.

Both sides have argued that given the intense controversy and scrutiny over the shooting, keeping a lid on public information about the identity of witnesses and Zimmerman's allegedly inconsistent statements given to police the night of the shooting would enable them to more fairly pursue justice.

However, the media companies countered that violates Florida's especially open public records laws. The judge ruled that under Florida law, more information needed to be made public. He also said that he needed 30 days to do that.

Zimmerman has claimed that he shot the unarmed 17-year-old Feb. 26 in self-defense.

The prosecution has accused the neighborhood watchman of "profiling" Martin, who is black; following him; and entering into a confrontation that eventually led him to draw his weapon and shoot Martin in the chest.

Zimmerman's attorney Mark O'Mara wrote on his blog that once he receives all the evidence from the state he will begin deposing about 50 witnesses, including experts. He added the trial is now not expected to begin until 2013.

O'Mara has brought on a new co-counsel to help him with the case, Orlando attorney Donald West, who specializes in murder cases.

West resigned from his post at the federal public defender's office in Orlando specifically to join O'Mara and defend Zimmerman.

.. something seems amiss here. The second passport troubles me. If Zimmerman told the truth as to what happened, why would he ever need to leave the country. I do not condone the lying about the money, but it is more understandable than the second passport lie.
